Terms of Service

Introduction

Welcome to milmentor.com, a platform owned and operated by Service to Success ("Company," "we," "our," or "us"). By accessing or using our website and services, you ("User") agree to comply with and be bound by the following terms and conditions ("Terms"). These Terms govern your use of the platform, which connects mentors, mentees, and companies within the military community.

Account Types and Responsibilities

  1. Mentor Accounts: Mentors provide background information, including military service history, and connect their LinkedIn profiles and calendars to facilitate scheduling calls to provide mentorship to military-connected mentees. Mentors must verify their email and phone number. They set their availability, and calls with mentees are automatically initiated at the scheduled time.
  2. Mentee Accounts: Mentees provide additional information relevant to their job search, such as industry of interest, desired job, resume, salary expectations, location, and more. Mentees can apply to jobs, register for events, access resources, and connect with mentors.
  3. Company Accounts: Companies seeking military talent gain access to job boards, a candidate database, and event registration. Company accounts provide relevant information about their business and representatives.

By creating an account, users affirm that the information they provide is accurate and agree to keep it up to date. Users are responsible for maintaining the confidentiality of their account credentials and all activity that occurs under their account.

Platform Use Guidelines

  1. Prohibited Activities: Users are prohibited from engaging in illegal activities, infringing intellectual property rights, or disrupting the platform’s services. This includes but is not limited to hacking, scraping, spamming, distributing harmful software, or engaging in activities that violate any applicable laws or regulations.
  2. Termination of Accounts:
    • Service to Success reserves the right to suspend or terminate your account at its sole discretion, with or without cause, and with or without prior notice.
    • If your account is suspended or terminated:
      • No Restoration or Data Retrieval: Service to Success is under no obligation to restore your account or provide you with access to any data associated with your account following suspension or termination.
      • No Refunds: Any fees paid for access to premium services or features of the platform or Company are non-refundable, regardless of account termination.
      • Permanent Ban: Users whose accounts are terminated for violations of these Terms may be permanently banned from accessing the platform or creating new accounts.
  3. Issue Reporting: Users should report issues, bugs, and offensive content to Service to Success by emailing welcome@servicetosuccess.com within 5 days of their discovery.
  4. User-Generated Content: By uploading or submitting content, users grant Service to Success a worldwide, royalty-free, non-exclusive license to use, display, modify, reproduce, distribute, and create derivative works from such content for marketing, promotional, or other purposes. The license is revocable upon the deletion of the content by the user, except where marketing material has already been made and distributed. Users retain ownership of their content but agree that the Company may use it in accordance with this license.

Limitation of Liability

  • Data Breaches: Service to Success is not liable for any unauthorized access, hacking, or breach of the platform's data, including user-provided information such as resumes, contact information, or other personal data to the fullest extent allowed by law.
  • Connection Issues: Service to Success is not liable for any inability for users to connect with mentors or mentees, or for mentees to secure employment as a result of using the platform.
  • Third-Party Actions: Service to Success is not liable for any actions or omissions of users on the platform, including mentors, mentees, or company representatives who are not employed by Service to Success.
  • Offensive Content: Users are solely responsible for the content they provide or display on the platform.
  • Service Interruptions: Service to Success is not responsible for interruptions, delays, or failures due to technical difficulties, maintenance, or other unforeseeable circumstances.
  • External Links: The platform may contain links to third-party websites, and Service to Success is not responsible for their content, security, or practices. Users access them at their own risk.

Intellectual Property

All content, trademarks, logos, and intellectual property on milmentor.com, except for user-generated content, are the property of Service to Success or its licensors. Unauthorized use of any such materials is strictly prohibited.

Indemnification

Users agree to indemnify and hold harmless Service to Success, its directors, officers, employees, and affiliates from any claims, liabilities, damages, or expenses (including attorney's fees) arising from the user's breach of these Terms, misuse of the platform, or violation of any applicable law or regulation.

Dispute Resolution

In the event of any dispute arising out of or related to these Terms or the use of milmentor.com:

  • Disputes will first be resolved through good-faith negotiations.
  • If negotiations fail, disputes will be submitted to binding arbitration administered by an arbitrator of Service to Success’s choosing.
  • The arbitration process will be confidential and conducted in Delaware. The arbitrator's decision shall be final and binding.
  • Users waive their right to participate in any class action lawsuit or class-wide arbitration.
  • Users may opt out of this provision within 7 days of joining the platform by emailing welcome@servicetosuccess.com.

Platform Data

  • Service to Success collects, uses, and stores personal data provided by users, including contact information, resumes, job-related data, and other relevant details.
  • This information may be shared with companies seeking to hire or reach military talent for employment, event opportunities, or other engagements.
  • While reasonable steps are taken to safeguard user data, absolute security cannot be guaranteed.

Changes to the Terms

Service to Success reserves the right to update or modify these Terms at any time. Notice of changes will be sent to users via the email address provided during registration at least 7 days before updates take effect. Continued use of the platform constitutes acceptance of the new Terms.

Governing Law

These Terms and the use of the platform are governed by the laws of the state of Delaware, without regard to conflict of law principles.

No Warranties

The MilMentor platform is provided "as is" without any warranties or guarantees, either express or implied. Users agree that Service to Success is not liable for any losses, damages, or other consequences resulting from their use of the platform.

Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue to be in full effect.
